Can I Add a Garden Unit to My 2-Flat in Chicago?

For most 2-flats, yes. Since April 1, 2026, Chicago lets owners add an extra apartment to their building in most of the city. If you have been eyeing a 2-flat with an unfinished basement, that basement may be a third apartment waiting to happen.

What changed

Chicago used to allow new garden units only in a few small pilot areas. In April 2026 the city made the program permanent and opened it up. If your building sits in the zoning most 2-flats and 3-flats have (the districts the city calls RT, RM, B, and C), you can add one extra unit by right. By right means no special hearing and no board to convince. You apply, you build. Blocks zoned only for single family homes need a sign-off from the local alderman first, and each alderman sets the fine print there. The city mapping site Chicago Cityscape puts the eligible area at about 60 percent of the city.

What counts

The city calls a new one a conversion unit, an apartment built inside the building you already own. You can also build a coach house, a small separate home in the backyard, where the lot allows it.

What the city checks

Three things. The ceiling: a basement unit needs at least 7 feet from floor to ceiling. The plans: drawn by a licensed architect. The paperwork: a pre-approval from the city's housing department, then a normal building permit.

Why this matters when you are buying

When you shop for a 2-flat, you are really shopping for what the building can become. A 2-flat with a tall, dry basement in the right zoning can become a three unit building. That is a third rent check helping pay the same mortgage, in a building you were buying anyway. Sellers price the building on what it is today. The upside is yours.
